Program Description

How To Enter by Cell Phone: If you have a text messaging capable cell phone and a Web data plan from a participating carrier, you may participate by responding to the on air solicitation or by going to the Website and following the directions to sign up by sending a text message to the short code 99799 with the text "boo" in the message. A premium subscription charge of $.99 plus applicable taxes and carrier fees will apply monthly for as long as you remain a participant.

In addition, you can signup for 'Most Haunted' news via text message by sending a text message to the short code 99799 with the text "boonews" in the message. During 'Most Haunted Live' (the live television broadcast) you may send a text message to 99799 with the text "boo cam" followed by a message that you would like to send to the television screen during the broadcast. All such text messages will have a character limitation of 150 characters or less depending on your carrier and handset. The Travel Channel will determine which text messages air onscreen during the live broadcast at its sole discretion. For all such text messages, standard text messaging rates and applicable taxes and fees apply whether you are sending the message or receiving the message. If you get an error message, please try again.

You may stop receiving text messages at any time by responding "end," "stop" or "quit" to any message that you receive from the Travel Channel. You may also send a text message to 99799 with the words "end," "stop" or "quit" to unsubscribe and opt out of the program. Please use caution and do not drive or operate heavy machinery while sending text messages or using the 'Most Haunted' applications.

Conditions of Participation:

1. You must be at least 18 years old. Minors, age 13 and older, may use the service with parental consent and supervision. You are responsible for the security of your own mobile phone.

2. The Ghost Detector will be connected to the network, and you may incur time or data charges depending on your carrier and what type of billing plan you are on. The Ghost Detector application is intended for entertainment purposes only and provides a measurement of variations in the electro-magnetic field generated by the transmission of the phone signal to the end user's cell phone. Such variations occur in the normal course of signal transmission and should not be considered accurate measurements of physical, scientific or paranormal data.

3. The Travel Channel may use the personally identifiable information we collect from you online to provide you with opportunities to offer you products and services that may be of interest to you. If you would like to opt out of future promotional materials from us, you may indicate this preference by following the unsubscribe instructions at the end of such communications. We may pass on your personal information, financial information and or demographic and usage information to your mobile phone service provider. By using the Program, you consent to any such transfer of information.

4. You may not use the 'Most Haunted' program for any illegal or improper purpose, including without limitation surveys, contests, pyramid schemes, chain letters, junk e-mails, spamming or the like. You may not defame abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others, or publish, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, harassing, indecent or unlawful material or information, or create a false identity for the purpose of misleading others as to your identity or the origin of a message, or otherwise violate any applicable laws or regulations. You acknowledge and agree that The Travel Channel has no obligation whatsoever to screen or pre-screen content or data that is uploaded, posted, emailed, transmitted or otherwise made available by you or any other user of the program. You agree that you bear all risks associated with, the use of any content or data provided by or via the Program, including any reliance on the accuracy, completeness, or usefulness of such content or data. The Travel Channel reserves the right to block or otherwise obstruct anyone who violates these Terms and Conditions in any manner without notice.

5. THE 'MOST HAUNTED' PROGRAM IS PROVIDED "AS IS." THE TRAVEL CHANNEL MAKES NO, AND HEREBY DISCLAIMS ANY, WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE OR PURPOSE. FURTHER, THE TRAVEL CHANNEL DISCLAIMS ANY WARRANTY THAT THE PROGRAM WILL BE AVAILABLE AT ALL TIMES OR WILL OPERATE WITHOUT INTERRUPTION OR ERROR.

6. NEITHER THE TRAVEL CHANNEL, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, NOR ITS CONTENT PROVIDERS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. You agree to indemnify, defend and hold The Travel Channel and its parent company, subsidiaries, affiliates, officers, directors, shareholders, contractors, agents, employees, licensors and assigns from all liabilities, claims, damages, costs and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of or in connection with (a) your use of the Program, and (b) the breach by you of your representations and warranties set forth herein.

PLEASE NOTE THAT A HIGH VOLUME OF MESSAGES OR ACCESS TO THE SITE TO DOWNLOAD THE GHOST DETECTOR, OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO PARTICIPATE OR DELAY THE PROCESSING OF MESSAGES SENT SUCH THAT YOUR TEXT MESSAGE IS NOT RECEIVED. THE TRAVEL CHANNEL AND ITS AFFILIATES ARE NOT RESPONSIBLE OR LIABLE SHOULD ANY MESSAGE NOT BE RECEIVED DUE TO SUCH DELAYS.

By participating in the program, you represent that you are at least 18 years of age (or are age 13 or older and participating in the Program with parental consent) and are accepting these terms and conditions as a legally binding agreement between you and The Travel Channel that may be enforced against you by The Travel Channel.
